Subject: 9802/City Code/1-8/General Penalty Provisions Date: Thu, 17 May 1990 11:50:00 -0500 ORDINANCE NO. 9802 AN ORDINANCE AMENDING PART II, CHATTANOOGA CITY CODE, BY PROVIDING FOR PENALTIES OF UP TO FIVE HUNDRED AND NO/100 DOLLARS ($500.00) FOR THE VIOLATION OF ANY CITY ORDINANCE AND AMENDING SECTION 1-8 AND OTHER SECTIONS OF SAID CODE IMPOSING A MAXIMUM FINE OR PENALTY SUBJECT TO CERTAIN EXCEPTIONS SET FORTH HEREIN. SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Part II, Chattanooga City Code, Part II, Section 1-8, be and is hereby amended by repealing the same and inserting in lieu thereof the following: Sec. 1-8. General penalty; exceptions; continuing violations. (a) Wherever in this Code or in any ordinance or rule or regulation promulgated by any officer of the city under authority vested in him by law or ordinance, any act is prohibited or is declared to be unlawful or a misdemeanor, or the doing of any act is required, or the failure to do any act is declared to be unlawful, the violation of any such provision of this Code or any such ordinance, rule or regulation shall be punished by a monetary penalty and forfeiture not exceeding five hundred dollars ($500.00). (b) Notwithstanding the provisions of subsection (a), the penalties set forth in Chapter 4 and in Sections 24-304, 24-322 and 24-329 of this Code are not affected by this Section 1-8. (c) Each day any violation of this Code or any such ordinance, rule or regulation continues shall constitute a separate offense. SECTION 2. BE IT FURTHER ORDAINED, That all other Sections of Chattanooga City Code, Part II, which impose a maximum fine or penalty of less than five hundred dollars ($500.00) be and are hereby amended by deleting the maximum amount of monetary fine or penalty therein and inserting a new maximum fine or penalty of five hundred dollars ($500.00), provided, that the penalties set forth in Chapter 4 and in Sections 24-304, 24-322 and 24-329 of this Code are not affected by this Ordinance. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two (2) weeks from and after its passage as required by law.
